END-USER LICENSE AGREEMENT (EULA) This software is provided by www.artdebugger.com ("Art Debugger", "the Developer", or "the Artist"). Please read this agreement carefully before using this software. By installing, running, or otherwise interacting with this software, you agree to the terms of this agreement. If you do not agree, do not use this software. By running, copying, or distributing this software, you agree to the following terms: 1. NO WARRANTY This software is provided without any guarantees or warranty. The Developer is not responsible for any issues, damages, or losses caused directly or indirectly by the use of this software. You use it at your own risk. 2. LIMITED LIABILITY This software is distributed as an experimental artwork. It may behave unexpectedly or be incompatible with some systems. Under no circumstances shall the Developer be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of the use or inability to use this software, even if the Developer has been advised of the possibility of such damages. 3. COMPATIBILITY AND SECURITY This software is provided as a standalone executable file for Windows. It is officially supported only on Windows 10 or later. Use on other operating systems or environments (e.g., through emulation or compatibility layers) is not supported and may result in unexpected behavior. The software may not be compatible with all systems, configurations, or third-party security products (such as antivirus software, firewalls, or operating system protections). Some antivirus programs may block or interfere with the software, including false-positive detections. It is your responsibility to ensure the software is used in a safe and secure environment. The Developer does not guarantee full compatibility or functionality under all conditions and is not responsible for any interference, restrictions, or resulting malfunctions. 4. PERMITTED USE Personal, non-commercial use of this software is allowed. Redistribution or modification is permitted only under the terms of the License (LICENSE.txt). 5. PERMITTED PUBLIC SHARING For detailed usage rights, including NFT holder permissions, refer to LICENSE.txt. This includes restrictions on redistribution and permitted public sharing. 6. NO DATA COLLECTION This software does not collect, store, or transmit any personal or identifying data. 7. TERMINATION This license is effective until terminated. You may terminate it at any time by deleting the software and all its associated files. The Developer may terminate this license at any time without notice if you fail to comply with any term of this agreement. 8. HEALTH AND SAFETY WARNINGS 8.1. This artwork contains depictions of smoking cigarettes. These representations are purely artistic and are not intended to encourage or promote smoking. Any depiction of smoking is not an endorsement of smoking or the development of harmful habits. 8.2. This artwork contains dynamic visual effects, including flashing lights and rapidly changing images, which may pose a risk to individuals with epilepsy or light sensitivity. If you have a history of epilepsy or light sensitivity, it is advised to refrain from viewing or interacting with this artwork. 8.3. This artwork may include imagery or themes that could provoke strong psychological or emotional reactions, such as visual distortions, disturbing imagery, or challenging concepts. Viewer discretion is advised. If you experience discomfort or distress, please cease interaction with the artwork immediately. 9. OWNERSHIP AND RIGHTS RESERVED This software is a creative work by Art Debugger. Purchasing the associated NFT grants the buyer a license to access, use, and display this specific version of the artwork for personal use or resale as an NFT. All copyrights, including the rights to exhibit, reproduce, distribute, modify, adapt, and create derivative works based on this software, remain solely with the artist. Purchasing an NFT does not grant ownership of the underlying artwork, source code, visuals, or concept, nor does it confer any exclusive rights beyond those specifically outlined for NFT owners. The Artist retains full legal rights to present, display, promote, modify, and commercially exploit the artwork in any form and in any venue, independently of any NFT transactions. By purchasing or using the NFT, you acknowledge and agree that no copyright ownership or exclusive usage rights are transferred to you. 10. LIMITATION OF LIABILITY AND WAIVER OF CLAIMS To the fullest extent permitted by law, the user agrees that the developer (Art Debugger) shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising from the use, misuse, or inability to use the software. By using this software, the user waives any right to make claims, demands, or legal actions against the developer, whether in contract, tort, or otherwise. 11. REFUNDS AND RESALE NFT purchases are final and non-refundable. By owning or using the software linked to an NFT, you agree that: - No refund or compensation will be provided under any circumstances, including dissatisfaction, technical issues, or disagreement with the terms. - Secondary buyers (those who purchase the NFT from a previous owner) are not entitled to any support, updates, or direct contractual rights from the developer. - All users must adhere to the terms in this EULA.txt and LICENSE.txt, regardless of how they acquired the NFT. 12. GOVERNING LAW This agreement shall be governed and interpreted in accordance with the laws of the jurisdiction where the Developer resides. 13. CONFLICT RESOLUTION In case of any conflict or inconsistency between this EULA.txt, the LICENSE.txt, README.txt, or content on the website: - Usage rights, redistribution, promotion, and commercial use are governed by the LICENSE.txt. - Installation, system compatibility, health & safety warnings, and liability disclaimers are governed by this EULA.txt. - Instructions, general descriptions, and user guidance are governed by the README.txt. - The website reflects a public summary and presentation of the software. It does not override the README.txt, LICENSE.txt or EULA.txt. If the relevant topic is not addressed in any document, the LICENSE.txt shall take precedence. If you do not agree to these terms, do not use, copy, or distribute this software. Delete all files associated with it from your device immediately.
